State Law: Legal Amounts of Homemade Wine

Wyoming laws regarding homemade wine are pursuant to the federal law which states the following:

The aggregate amount of wine exempt from tax under this subsection with respect to any household shall not exceed – (1) 200 gallons per calendar year if there are 2 or more adults in such household, or (2) 100 gallons per calendar year if there is only 1 adult in such household.

Title 12 Alcoholic Beverages

Chapter 1 General Provisions Section 101 Definitions

“Alcoholic liquor” means any spirituous or fermented fluid, substance or compound other than malt beverage intended for beverage purposes which contains at least one-half of one percent (.5%) of alcohol by volume. As used in this paragraph, “beverage” does not include liquid filled candies containing less than six and one-quarter percent (6.25%) of alcohol by volume.

“Intoxicating liquor”, “alcoholic liquor”, “alcoholic beverage” and “spirituous liquor” are construed as synonymous in meaning and definition.

“Person” includes an individual person, partnership, corporation, limited liability company or any other association or entity, public or private.

Chapter 8 Penalties Article 1 In General Section 102 Manufacturing, rectifying or sale without license or permit; penalties

…..Nothing in this subsection shall prohibit any person from manufacturing fermented or malt beverages in limited quantities for his sole personal consumption.
