State Law: Legal Amounts of Homemade Wine

Utah laws regarding homemade wine are pursuant to the federal law which states the following:

The aggregate amount of wine exempt from tax under this subsection with respect to any household shall not exceed – (1) 200 gallons per calendar year if there are 2 or more adults in such household, or (2) 100 gallons per calendar year if there is only 1 adult in such household.

Chapter 1 Section Alcoholic Beverage Control General Provisions Section 102 Definitions

“Alcoholic beverage” means the following: beer; or liquor.

“Alcoholic product” means a product that: contains at least .5% of alcohol by volume; and is obtained by fermentation, infusion, decoction, brewing, distillation, or other process that uses liquid or combinations of liquids, whether drinkable or not, to create alcohol in an amount  equal to or greater than .5% of alcohol by volume.

“Alcoholic product” includes an alcoholic beverage.

“Liquor” means a liquid that is: alcohol; an alcoholic, spirituous, vinous, fermented, malt, or other liquid; a combination of liquids a part of which is spirituous, vinous, or fermented; or other drink or drinkable liquid; and contains at least .5% alcohol by volume; and is suitable to use for beverage purposes.

“Liquor” includes: heavy beer; wine; and a flavored malt beverage.

“Wine” means an alcoholic product obtained by the fermentation of the natural sugar content of fruits, plants, honey, or milk, or other like substance, whether or not another ingredient is added.

“Wine” is considered liquor for purposes of this title, except as otherwise provided in this title.

Chapter 11 Manufacturing and Related Licenses Act Section 202 Exemption for manufacture in personal residence of fermented beverage

As used in this section, “fermented alcoholic beverage” means: beer; heavy beer; or wine.

An individual may without being licensed under this chapter manufacture in the individual’s personal residence a fermented alcoholic beverage if:

the individual is 21 years of age or older;

the individual manufactures no more than:

100 gallons in a calendar year, if there is one individual that is 21 years of age or older residing in the household; or

200 gallons in a calendar year, if there are two or more individuals who are 21 years of age or older residing in the household;

the fermented alcoholic beverage is manufactured and used for personal or family use and consumption, including use at an organized event where fermented alcoholic beverages are judged as to taste and quality; and

the fermented alcoholic beverage is not for:

sale or offering for sale; or

consumption on a licensed premise.
